Your California Privacy Rights
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, provides you with specific rights regarding your personal information. These rights give you greater control over how businesses collect, use, and share your personal information, and they require businesses like FlashCloud to be transparent about their data practices. This page specifically addresses your right to opt out of the sale or sharing of your personal information. If you wish to exercise this right or learn more about how to do so, the information below will guide you through the process.
Understanding Sale and Sharing Under California Law
Under the California Consumer Privacy Act, the term "sale" has a broad definition that goes beyond traditional commercial transactions. A sale under the CCPA means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a consumer's personal information to a third party for monetary or other valuable consideration. This definition captures many types of data sharing arrangements that consumers might not typically think of as sales. The California Privacy Rights Act introduced an additional concept of "sharing" that is distinct from sale. Under the CPRA, sharing means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating a consumer's personal information to a third party for cross-context behavioral advertising, commonly known as targeted advertising, whether or not monetary consideration is involved. FlashCloud does not sell your personal information in the traditional sense of exchanging it for money. However, like many companies that operate websites, we work with advertising and analytics partners who may collect information through cookies and similar technologies on our website. Under the broad definitions established by California law, these activities may constitute sharing of personal information for targeted advertising purposes. The categories of personal information that may be shared for targeted advertising include identifiers such as IP addresses and device identifiers, which are shared with advertising networks to enable targeted advertising. Internet activity information such as browsing history on our website is shared with analytics providers and advertising networks. Inferences about your preferences and interests, which are derived from your browsing behavior, are shared with marketing partners for personalization and advertising purposes.
What Opting Out Means
If you choose to opt out of the sale or sharing of your personal information, FlashCloud will stop sharing your personal information with third parties for the purpose of targeted advertising. We will disable non-essential tracking cookies on your browser that are used for advertising purposes. You may still see FlashCloud advertisements when browsing other websites, but those advertisements will not be personalized based on your browsing activity on our website. Opting out does not affect your ability to use our services or access any features of our website. It also does not affect our sharing of information that is necessary to provide our services to you, such as payment processing information shared with our payment processors. Our sharing of information with service providers who process data on our behalf under contractual restrictions will continue, as this type of sharing is permitted under California law. Our sharing of information as required by law or for legal compliance purposes will also continue. We will continue to be able to share aggregate or de-identified data that cannot reasonably be used to identify you. Your receipt of transactional communications about your account will not be affected.
How to Opt Out
FlashCloud provides several methods through which you can submit an opt-out request. You may submit an opt-out request through our online form, which will be available at /legal/ccpa-opt-out when our website is live. This is the fastest and most convenient method for most users. You may submit an opt-out request by sending an email to privacy@flashcloud.com with the subject line "Do Not Sell or Share My Personal Information." In your email, please include your full name, the email address associated with your FlashCloud account if you have one, your state of residence so that we can confirm you are a California resident, and a clear statement that you wish to opt out of the sale or sharing of your personal information. You may also submit an opt-out request by calling our privacy hotline. Please contact our support team at support@flashcloud.com for the current phone number for privacy requests. FlashCloud honors Global Privacy Control signals. If your browser sends a Global Privacy Control signal when you visit our website, we will automatically treat it as an opt-out request, and no further action is required on your part. To enable Global Privacy Control, you can use a browser that supports GPC, such as Firefox, Brave, or DuckDuckGo, and enable the GPC setting in your browser preferences. For more information about Global Privacy Control, visit https://globalprivacycontrol.org. You can also manage your cookie preferences through the Cookie Settings tool available on our website. Disabling targeting and advertising cookies through this tool will limit the sharing of your information for targeted advertising purposes.
What Happens After You Submit a Request
When we receive your opt-out request, we will send you an immediate confirmation that we have received it. For most opt-out requests, we do not require identity verification because opting out does not provide access to your personal data. However, we may need to verify your identity if you are also requesting information about your personal data, if the request appears potentially fraudulent, or if we cannot associate your request with data in our systems. Your request will be processed within fifteen business days of receipt. Upon completion, we will send a confirmation to the email address you provided, update our systems to reflect your opt-out preference, and communicate your opt-out to relevant third-party advertising partners with whom we have been sharing your information.
Authorized Agents
You may authorize another person or entity to submit an opt-out request on your behalf. If you wish to use an authorized agent, you must provide written authorization to your agent that is signed by you. Your agent must submit the opt-out request along with the signed authorization. We may contact you directly to verify that you authorized the request and to confirm your identity. If you are an authorized agent submitting a request on behalf of a California consumer, please include your name and contact information, the name of the consumer on whose behalf you are submitting the request, the signed authorization from the consumer, and any documentation establishing your authority to act on the consumer's behalf.
Additional California Privacy Rights
In addition to the right to opt out of sale and sharing, California residents have several other rights under the California Consumer Privacy Act. You have the right to know what personal information we collect about you. You may request that we disclose the categories of personal information we have collected, the sources from which we collected it, the business or commercial purposes for collecting or selling it, the categories of third parties with whom we share it, and the specific pieces of personal information we have collected about you. You have the right to delete personal information we have collected from you, subject to certain exceptions. For example, we may need to retain certain information to complete a transaction, detect security incidents, comply with legal obligations, or exercise legal rights. You have the right to correct inaccurate personal information that we maintain about you. If you believe that personal information we hold about you is incorrect, you may request that we correct it. You have the right to limit the use and disclosure of sensitive personal information to purposes that are necessary to provide the services you have requested. You have the right to non-discrimination, which means that we will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge you different prices or rates, provide you with a different level or quality of service, or suggest that we will do any of these things because you exercised your rights. To exercise any of these additional rights, please send an email to privacy@flashcloud.com with the subject line indicating the specific right you wish to exercise, such as "Data Access Request" or "Deletion Request." We will respond to your request within forty-five days, with a possible extension of another forty-five days if necessary for complex requests.
