Acceptable Use Policy

Lawful Use Requirement
FlashCloud services may only be utilized for lawful purposes that comply with all applicable federal, state, local, and international laws and regulations. Each customer bears full responsibility for ensuring that their use of FlashCloud services, including all content stored, transmitted, or made accessible through our infrastructure, conforms to all legal requirements applicable to their activities. The determination of what constitutes lawful use depends on the jurisdiction in which the customer operates and the nature of the content and activities involved. FlashCloud does not position itself as a law enforcement body, regulatory agency, or arbiter of legality in matters where legal interpretation may be subject to reasonable dispute. However, FlashCloud reserves the absolute right to take appropriate action, including but not limited to disablement, suspension, or termination of services, in response to clear, credible, and substantiated indications that a customer is engaging in unlawful activity through our platform. Such determinations are made at FlashCloud's sole discretion based on the information available at the time. Certain categories of content are unambiguously prohibited regardless of jurisdiction. Child Sexual Abuse Material, commonly referred to as CSAM, is strictly prohibited under all circumstances and is subject to immediate removal and mandatory reporting to the National Center for Missing and Exploited Children and appropriate law enforcement authorities. Similarly, the hosting of copyrighted materials without proper authorization, licensing, or legal right to reproduce and distribute such materials constitutes copyright infringement and violates both our policies and applicable law. The use of FlashCloud's infrastructure to plan, coordinate, conspire, commit, or otherwise support or facilitate illegal activities of any kind is strictly forbidden and may result in immediate termination and cooperation with law enforcement investigations.
Prohibition on Malicious Hacking Activities
The use of FlashCloud's infrastructure to engage in, coordinate, facilitate, or otherwise support malicious hacking activities is strictly prohibited without exception. This prohibition encompasses all forms of unauthorized access attempts, security exploits, and attacks directed at computer systems, networks, or services, whether those targets are owned by FlashCloud, other FlashCloud customers, or third parties unaffiliated with FlashCloud. Customers may not use FlashCloud services to distribute, host, or make available tools, software, scripts, exploits, or other resources that are primarily designed or commonly used for gaining unauthorized access to computer systems or networks. This includes but is not limited to vulnerability scanners used without authorization, password cracking tools, exploit kits, and remote access trojans. Similarly, the use of FlashCloud infrastructure to disrupt, degrade, or attack any system, service, network, or resource is prohibited. Attempting to access, probe, scan, or test any system, account, or network without the explicit, informed consent of the system's owner is a serious violation of this policy. The only exception to these prohibitions is for legitimate security research activities conducted by authorized security professionals with explicit written permission from all relevant system owners. Such activities must be documented and conducted in accordance with responsible disclosure practices. FlashCloud may require advance notification and evidence of authorization before permitting security research activities that might otherwise appear to violate this policy.
Prohibition on Service Disruption Activities
Any activity that causes, attempts to cause, or is reasonably likely to cause service interruptions or degraded performance to FlashCloud's infrastructure, other customers' services, or any external systems or networks is strictly prohibited. This prohibition is essential to maintaining the reliability, availability, and performance of our services for all customers and to preventing harm to the broader internet ecosystem. Denial of Service attacks, commonly referred to as DoS attacks, which involve overwhelming a target system with traffic or requests in order to render it unavailable to legitimate users, are absolutely forbidden regardless of whether the target is a FlashCloud resource or an external system. Distributed Denial of Service attacks, known as DDoS attacks, which utilize multiple systems to amplify the scale and impact of such attacks, are equally prohibited. Customers found to be originating, coordinating, or participating in such attacks are subject to immediate termination of all services without refund. The deployment of maliciously configured software, including but not limited to network amplification tools, botnets, and traffic generators designed to consume excessive resources or generate harmful traffic, violates this policy. Customers are responsible for ensuring that software they deploy on FlashCloud infrastructure is configured appropriately and does not inadvertently participate in attacks or cause harm to other systems. If FlashCloud determines that a customer's systems are being used, whether knowingly or unknowingly, to conduct or facilitate service disruption activities, FlashCloud will take immediate protective action which may include suspension of the affected services.
Prohibition on Cryptocurrency Mining
The mining of cryptocurrency in any form is prohibited on all FlashCloud platforms without exception. This prohibition exists because cryptocurrency mining operations consume substantial computational resources, generate excessive heat, and cause accelerated wear on hardware components, all of which negatively impact service quality for other customers and impose costs that are not reflected in standard hosting fees. This prohibition applies to all forms of cryptocurrency mining, including individual mining operations where a single device performs mining calculations, collective or pool mining where resources from multiple systems are combined, and cloud mining arrangements where customers lease or utilize FlashCloud resources as part of broader mining operations. The prohibition extends to all digital currencies and tokens, including but not limited to Bitcoin, Ethereum, Litecoin, and any other current or future cryptocurrency regardless of the specific mining algorithm employed. Customers who require computational resources for cryptocurrency mining should seek hosting providers that specialize in such services and have infrastructure specifically designed to accommodate the unique demands of mining operations. FlashCloud actively monitors for mining activity and will take enforcement action against accounts found to be in violation of this prohibition.
Anti-Spam Policy
Spamming in all its forms is strictly prohibited on FlashCloud services. Spam undermines the integrity of email communications, damages sender reputation, and consumes resources that could otherwise serve legitimate purposes. FlashCloud maintains a zero-tolerance approach to spam and takes aggressive action against customers who engage in spam activities. Customers agree not to utilize, distribute, install, or make available any tools, software, scripts, or methods designed to send or facilitate the sending of unsolicited email or usenet postings. The term "unsolicited" refers to communications sent to recipients who have not provided clear, affirmative consent to receive such messages. This prohibition applies regardless of the content of the messages or the commercial or non-commercial nature of the communication. Customers may not use FlashCloud infrastructure to relay unsolicited email or usenet postings, whether originated from FlashCloud servers or external systems. Similarly, customers may not use unsolicited email or usenet postings sent from any source to advertise, promote, or drive traffic to websites or services hosted at FlashCloud. Engaging in such activities, whether directly or through third-party services, constitutes a violation of this policy. FlashCloud monitors outgoing email traffic for patterns indicative of spam activity and may automatically throttle, restrict, or suspend email privileges for accounts exhibiting suspicious patterns. Customers who believe their email capabilities have been restricted in error should contact support to discuss the situation and, if appropriate, have restrictions removed. Prohibition on Personal Information Harvesting
The collection, aggregation, or harvesting of email addresses, usernames, or other personal identifiers belonging to individuals without their explicit, informed consent is strictly prohibited. This prohibition exists to protect the privacy of individuals, prevent spam and fraudulent activities, and ensure compliance with applicable privacy regulations. Phishing activities, which involve deceptive practices designed to trick individuals into revealing personal information, login credentials, financial data, or other sensitive information, are strictly forbidden. This includes the creation of deceptive websites, emails, or other communications that impersonate legitimate entities or services. Internet scamming, confidence schemes, and fraudulent activities of all kinds that target individuals for financial or personal gain are similarly prohibited. Password robbery, which involves the collection of login credentials through deceptive means, keylogging, man-in-the-middle attacks, or other unauthorized methods, violates this policy and applicable law. Spidering and harvesting activities that systematically collect email addresses or other personal identifiers from websites, directories, or other sources without authorization are prohibited. Customers may not operate or host services that facilitate such collection activities.
IP Address Blacklisting and Reputation
Customers acknowledge and agree that if a FlashCloud IP address assigned to their account becomes listed on an abuse database, email blacklist, spam block list, or similar reputation service, such listing constitutes a violation of this Acceptable Use Policy regardless of the specific cause of the listing. The reputation of IP addresses is a valuable shared resource, and customers bear responsibility for maintaining the reputation of addresses assigned to their accounts. FlashCloud reserves the right to take reasonable action to protect the reputation of its IP address space and the deliverability of email for all customers. Such action may include the suspension or termination of services for accounts associated with blacklisted addresses, reassignment of IP addresses, or other measures FlashCloud deems appropriate under the circumstances. These actions may be taken regardless of whether the blacklisting was a direct result of the customer's deliberate actions or occurred due to security compromises, misconfigurations, or other indirect causes. Customers are encouraged to implement proper security measures, configure email authentication protocols such as SPF, DKIM, and DMARC, and follow email best practices to minimize the risk of blacklisting. Customers who discover that addresses assigned to their accounts have been blacklisted should immediately investigate the cause, remediate any underlying issues, and work with FlashCloud support to restore proper functionality.
Prohibition on Investment and Financial Trading Platforms
The operation of certain categories of investment and financial trading platforms is prohibited on all FlashCloud infrastructure due to the elevated regulatory requirements, legal risks, and potential for fraud associated with such services. This prohibition specifically encompasses FOREX trading platforms that facilitate foreign exchange speculation, cryptocurrency exchanges that enable the buying, selling, or trading of digital currencies, and similar financial services or sites that involve investment, speculation, or the trading of financial instruments. This prohibition exists because such platforms are subject to extensive regulation by financial authorities in various jurisdictions, and operating such platforms without proper licensing and compliance infrastructure exposes both the operator and FlashCloud to significant legal risk. Additionally, these categories of services have historically been associated with fraudulent schemes, market manipulation, and consumer harm. Customers seeking to operate legitimate, properly licensed financial services should seek hosting providers that specialize in financial services infrastructure and can provide the compliance support and regulatory expertise such operations require.
Prohibition on Spoofing and Impersonation
The use of FlashCloud infrastructure to impersonate another person, organization, company, government entity, or other entity is strictly prohibited regardless of the purpose or intent behind such impersonation. This prohibition applies to all forms of communication and interaction, including email messages, internet forum posts, social media interactions, website content, and any other means of communication or representation. Spoofing of email headers, network packet headers, or other technical identifiers to make communications appear to originate from a source other than their true origin is forbidden whether or not the spoofing is performed for malicious purposes. Such activities can facilitate phishing, fraud, and other harmful activities, and they undermine trust in digital communications. Even spoofing performed for seemingly innocuous purposes violates this policy due to its potential for misuse and the difficulty of distinguishing benign spoofing from malicious activity. Customers may not create websites, accounts, or other online presences that impersonate or could reasonably be confused with official sites, accounts, or communications of other entities. This includes typosquatting, lookalike domains, and other practices designed to deceive users about the identity of the entity they are interacting with.
Prohibition on Spamdexing and Black Hat SEO
Customers agree not to engage in spamdexing, Black Hat SEO, or other manipulative practices designed to artificially inflate search engine rankings through deceptive or prohibited means. Search engine optimization should be performed using legitimate, ethical techniques that improve the quality and relevance of content for users rather than attempting to game search algorithms through technical manipulation. Black Hat SEO techniques, which include but are not limited to keyword stuffing, hidden text, cloaking, link schemes, and automated content generation designed to manipulate rankings, are prohibited. The operation of "scraper sites" that aggregate content from other sources without adding substantial value, primarily for the purpose of generating advertising revenue through search traffic, is similarly forbidden. These activities are prohibited not only because they violate search engine terms of service and can result in penalties affecting all sites on shared infrastructure, but also because they often generate substantial server load that degrades performance for other customers. Sites found to be engaging in spamdexing or Black Hat SEO practices may be suspended or terminated without notice, and customers may be required to pay for resources consumed by such activities.
Prohibition on Retaliation-Inducing Conduct
Any conduct by a customer that is reasonably likely to result in retaliation against FlashCloud's infrastructure, network, employees, officers, contractors, or other agents is strictly prohibited. Customers have a responsibility to conduct their activities in a manner that does not expose FlashCloud or its other customers to harm arising from the customer's actions. This prohibition specifically encompasses conduct that is likely to result in FlashCloud servers, networks, or services becoming the target of denial of service attacks, hacking attempts, or other retaliatory actions. Examples of such conduct include engaging in online harassment campaigns, participating in controversial or inflammatory activities that generate hostile responses, or operating services that are known targets for cyberattacks. Customers whose activities result in attacks against FlashCloud infrastructure bear responsibility for the resulting disruption and may be required to reimburse FlashCloud for mitigation costs, upgrade to isolated infrastructure, or terminate their services. FlashCloud will attempt to notify customers of concerning patterns before taking enforcement action where circumstances permit, but reserves the right to take immediate protective action when necessary to protect infrastructure and other customers.
Resource Usage and Personal Storage Restrictions
With the exception of FlashCloud Dedicated Servers, Cloud products, and VPS instances, customers agree to utilize FlashCloud's hosting servers primarily for the purpose of hosting websites and their associated email functionality. The resources provided with shared hosting plans are allocated based on the assumption that customers will use them for web hosting activities, and pricing reflects this intended use case. Data uploaded to shared hosting accounts must be primarily for website hosting purposes. FlashCloud hosting servers are not intended or appropriate for use as personal data backup or archiving repositories. Customers may not use shared hosting accounts for storing personal file collections, media libraries, or other data that is not actively used as part of a hosted website. Similarly, customers may not use shared hosting email services for importing or storing personal mail archives that are not related to ongoing email communications. Forwarding all emails from addresses hosted elsewhere for the purpose of creating an archival copy is prohibited, as is using hosting accounts for file storage purposes such as storing footage from security cameras, using email to transfer files for storage purposes, or similar archival activities. FlashCloud reserves the right to identify accounts being used primarily for storage rather than web hosting and to delete personal backups and archives from such accounts. In some cases, FlashCloud may offer customers the opportunity to pay additional charges to retain such data or to migrate to appropriate storage services, but this accommodation is offered at FlashCloud's sole discretion and is not guaranteed. Customers requiring data backup or archival services should utilize services specifically designed for such purposes. Bandwidth usage is included with hosting plans as specified during the order process. Customers who exceed their allocated transfer bandwidth during any billing month will be charged at the rate of one dollar per additional ten gigabytes of transfer, or such other rate as may be specified in the customer's service agreement.
Prohibition on Abusive Scripts and Processes
Any script, application, or process that adversely affects the ability of other customers to satisfactorily use their provided services, or that negatively impacts FlashCloud infrastructure, server performance, network capacity, or service availability, is prohibited. The shared nature of many hosting services requires that customers exercise responsible resource usage to ensure fair access for all. CPU-intensive CGI scripts, PHP applications, and other processes that consume disproportionate computational resources relative to what is appropriate for shared hosting environments are prohibited on shared hosting platforms. Websites whose traffic volumes have exceeded levels appropriate for shared hosting, resulting in resource consumption that impacts other customers, must be upgraded to VPS, dedicated server, or cloud hosting that provides dedicated resources appropriate to the site's demands. FlashCloud monitors resource usage across its infrastructure and may contact customers whose resource consumption patterns are causing or likely to cause problems for other customers. Customers are expected to respond promptly to such notifications and take appropriate action to optimize their resource usage, upgrade to more appropriate services, or otherwise resolve the identified issues. Failure to address resource usage concerns may result in throttling, suspension, or termination of the affected services.
Prohibition on IRC Software
All IRC bots, IRC bouncers, and similar software or services that maintain persistent connections to Internet Relay Chat servers or that mask, obscure, or modify user IP addresses in connection with IRC usage are prohibited on all FlashCloud platforms without exception. This prohibition applies regardless of the specific purpose for which such software might be used. IRC bouncers and persistent connection software consume resources and maintain long-running network connections that are inappropriate for shared hosting environments. Additionally, IRC services have historically been associated with various forms of abuse including botnet command and control, harassment, and other problematic activities. While legitimate uses for IRC software exist, the prevalence of abuse and the resource characteristics of such software justify this prohibition across all FlashCloud services. Customers requiring IRC connectivity for legitimate purposes should seek hosting providers that specifically support such services or operate their own dedicated infrastructure.
Prohibition on BitTorrent Software
Although FlashCloud recognizes that the BitTorrent protocol has legitimate value as a distributed file distribution method for certain applications, the protocol is far too easily abused and misused to permit its operation on FlashCloud platforms. Accordingly, BitTorrent client software, tracker software, and any other software that participates in the BitTorrent protocol is prohibited on all FlashCloud services. The high bandwidth consumption associated with BitTorrent usage, combined with the protocol's common association with copyright infringement and the difficulty of distinguishing legitimate from infringing uses, necessitates this blanket prohibition. Customers requiring BitTorrent capabilities for legitimate content distribution should seek specialized hosting providers or operate dedicated infrastructure designed for such purposes.
Prohibition on Proxy Software
All proxy software, whether anonymous or non-anonymous, public or private, is prohibited on all FlashCloud platforms. This prohibition encompasses VPN server software, SOCKS proxies, HTTP proxies, web-based proxy services, and any other software or services that relay, forward, or tunnel traffic for users other than the account holder. Proxy services are commonly used to obscure the origin of traffic, bypass geographic restrictions, and facilitate activities that violate policies or law. While legitimate uses for proxy services exist, the potential for abuse and the difficulty of ensuring that proxy services are not misused justify this prohibition. The operation of Tor exit nodes, open relay services, or similar anonymous routing infrastructure is specifically prohibited. Customers who require proxy or VPN services for legitimate business purposes should seek hosting providers that specialize in such services and can provide appropriate terms of service and acceptable use policies for those specific use cases.
Restrictions on Network Daemons
With the exception of FlashCloud Dedicated Servers, Cloud products, and VPS instances, the operation of any process that opens a network socket to accept inbound connections from external networks is prohibited on shared hosting platforms. Shared hosting resources are designed and allocated for web hosting purposes where incoming connections are handled by FlashCloud's web server infrastructure rather than by customer-operated daemons. Processes may bind to and accept connections on the localhost interface only for purposes of internal communication between components of a web application. However, even such local processes are held to the same resource limitations that apply to all other processes on shared hosting and must not consume more than their fair share of available resources or negatively impact FlashCloud infrastructure or other customers. Customers requiring the ability to operate custom network daemons, game servers, chat servers, or other applications that accept inbound connections should utilize VPS, dedicated server, or cloud hosting that provides the necessary capabilities and dedicated resources.
Prohibited Customer Content
Throughout the course of utilizing FlashCloud services, customers are responsible for ensuring that their content complies with all applicable laws and this Acceptable Use Policy. Customer content must not infringe any copyright, trademark, patent, trade secret, or other proprietary rights belonging to any party. Content that professes hatred against particular social, ethnic, religious, or other groups based on protected characteristics is prohibited. Customer content must not contain computer viruses, Trojan horses, worms, ransomware, spyware, adware, malware, or other malicious code, nor may it contain corrupted files designed to cause harm. The hosting of illegal software, commonly known as "warez," including pirated software, cracking tools, and related materials, is strictly prohibited. Customer content may not include proxy servers, traffic relaying programs, or tools designed to circumvent security measures. Content that promotes illegal money-making schemes, multi-level marketing operations, pyramid schemes, or similar activities is prohibited. Torrent trackers, torrent portals, and related software may not be hosted, and FlashCloud services may not be used to operate peer-to-peer networks or file sharing systems. Pornographic and obscene content, unlawfully harassing materials, and content connected with child abuse are strictly prohibited without exception. Customer content may not contain third-party private information that has been collected, stored, or processed without appropriate legal basis under applicable privacy laws. Protected health information as defined under the Health Insurance Portability and Accountability Act may not be hosted on FlashCloud services, as discussed further below. Content that advertises or supports the use or sale of controlled substances without proper authorization from relevant regulatory authorities is prohibited. Customer content may not contain material that is unlawful, abusive, threatening, harassing, defamatory, or libelous. Additionally, customers may not host content that constitutes fake news, disinformation, or intentionally misleading, untruthful, or materially inaccurate information designed to deceive readers.
High-Risk Activity Prohibition
FlashCloud services may not be used for hosting websites, applications, or systems related to high-risk activities where the interruption, malfunction, or failure of services could reasonably be expected to result in death, personal injury, severe environmental damage, or other catastrophic consequences. The service levels, redundancy, and support capabilities provided by FlashCloud are not designed or appropriate for such critical applications. Examples of prohibited high-risk applications include but are not limited to control systems for nuclear facilities, power generation or distribution systems, air traffic control systems, aviation control systems, transportation safety systems, medical life support systems, emergency response systems, weapons systems, and any other applications where service disruption could have catastrophic consequences. Customers operating in industries where such critical systems are present must ensure that FlashCloud services are used only for non-critical functions and that appropriate purpose-built infrastructure is employed for any systems where failure could result in serious harm.
HIPAA Non-Compliance Disclaimer
FlashCloud services do not comply with the requirements of the Health Insurance Portability and Accountability Act of 1996, commonly known as HIPAA, or its implementing regulations. Customers are expressly and strictly prohibited from hosting, storing, transmitting, distributing, displaying, or otherwise making available any Protected Health Information, or PHI, as that term is defined under HIPAA and the regulations promulgated thereunder. This prohibition applies regardless of whether the customer would otherwise be considered a Covered Entity or Business Associate under HIPAA. FlashCloud does not enter into Business Associate Agreements and does not provide the administrative, physical, and technical safeguards required for HIPAA compliance. Healthcare providers, health plans, healthcare clearinghouses, and their business associates who require hosting for systems that handle PHI must seek hosting providers that specifically offer HIPAA-compliant infrastructure and are willing to enter into appropriate Business Associate Agreements.
Policy Enforcement
FlashCloud does not provide legal advice regarding whether specific customer content or activities comply with applicable laws, and nothing in this policy should be construed as such advice. Customers bear sole responsibility for conducting their own assessment of legal compliance and for ensuring that their content and activities conform to all applicable legal requirements. When FlashCloud determines, in its sole discretion, that a customer's use of services violates this Acceptable Use Policy, FlashCloud may take corrective action as it deems appropriate under the circumstances. Such action may include deletion or disabling of specific customer content, suspension of specific services or features, termination of the customer's entire service agreement, or any other action FlashCloud determines is necessary to address the violation and protect its infrastructure and other customers. Enforcement actions may be taken with or without prior notice to the customer depending on the severity and urgency of the violation. In cases involving illegal content, imminent harm, or serious violations, immediate action may be taken without opportunity for the customer to cure. No refunds will be provided for services terminated due to policy violations, and customers may be liable for costs incurred by FlashCloud as a result of the violation.
Reporting Policy Violations
Any violation of this Acceptable Use Policy may be reported to FlashCloud by sending an email to compliance@flashcloud.com. Reports should include sufficient detail to enable FlashCloud to identify the content or activity in question and to evaluate the claim. FlashCloud will review all reports received through this channel and take appropriate action based on the nature and severity of the reported violation.
